World IP Day Celebration 2014

Innovation and creativity are inextricably linked to the protection of intellectual property (IP). It is therefore essential, in order to promote the sciences and useful arts, that all content creators and stakeholders be aware of the legal mechanisms for the protection of IP and its application to their work.

The Chair of IP Law, in cooperation with InnovUS and Von Seidels, is proud to again host the annual public event on Stellenbosch campus to celebrate World IP Day and raise awareness about IP among students and staff from all Faculties.

In keeping with the global theme of World IP DayMovies – A Global Passion, a free film will be screened at the Pulp Cinema. All participants will also have the opportunity to learn from IP experts about the relevant aspects of the law applicable to their field of work or study.

The Chair of Intellectual Property Law will present its annual public lecture on 15 April 2014 with Dr Frederick Mostert, Chief Legal Counsel for the Richemont Group of companies which include Cartier, Montblanc, Alfred Dunhill and Van Cleef & Arpels. The topic of Dr Mostert’s address is “Hacking Back and Hot Pursuit to Protect IP Assets – a Scoop on the TradeKey Case”.

In an age of digital threats, Dr Mostert will discuss the potential methods to protect intellectual property rights online. From the intermediary liability of marketplaces to tracing and hacking back online counterfeiters and hackers, the lecture will focus on the legal grounds and methods for combatting digital infringement.

The significant TradeKey Case dealt with several questions including:

  • If you buy illegal goods on-line through a website are you or the website acting unconscionably and unlawfully and liable to legal sanctions?
  • What is the culpability of a website that directs potential customers to other websites that offer unlawful goods?
  • Is on-line trading a free for all that enables its players to be untouchables?
  • How do IP rights holders combat the sale of counterfeit goods on-line that threaten to destroy the very fabric of their businesses?

Learn how spirited trade mark owners surreptitiously infiltrated a carefully spun web of dishonesty and deceit and exposed unlawful trading practices on the internet by using counter-espionage measures, resulting in a notable precedent setting court victory against cyber bandits.

IP Public Lecture 2014

About the speaker: 

Dr Frederick Mostert holds the degrees BA (Law) cum laude, LLB cum laude and LLD from the University of Johannesburg and an LLM in Intellectual Property and Corporate Finance from Columbia University School of Law. He is also a solicitor of England and Wales and a Member of the New York Bar.

Dr Mostert is currently Chief Legal Counsel for the Richemont Group of companies which include Cartier, Montblanc, Alfred Dunhill and Van Cleef & Arpels.  He is also an executive director of Compagnie Financière Richemont SA since September 2010, Richemont International Limited since December 1991, Reinet Investments Manager S.A. and Reinet Fund Manager S.A. since September 2010. Prior to this he was an associate in the corporate department of Shearman & Sterling in New York and thereafter an associate in the international trade mark department of the firm Weiss Dawid Fross Zelnick & Lehrman P.C., also in New York.

He was appointed guest professor of Peking University, Beijing in 2002 and is a visiting professor at the University College, London and a fellow of the London School of Economics.

As an international IP expert, Dr Mostert has served as the president, honorary chairman and member of the board of the International Trademark Association (INTA). He is also a founding member of the Industry Advisory Commission of the World Intellectual Property Organisation (WIPO) and a member of the Panel of Experts of the WIPO  Internet Domain Name Process. He has served as a member of the Advisory Board of the European Union Observatory on Infringements of Intellectual Property Rights, under the auspices of the Office for Harmonisation of the Internal Market (OHIM).

Dr Mostert also serves on the advisory boards of the McCarthy Center for Intellectual Property & Technology Law at the University of San Francisco, The British Walpole Committee in London, The Art Science Research Laboratory in New York and the Teacher of Ten Thousand Generations Foundation in Hong Kong.

As an IP scholar, Dr Mostert has served on the Editorial Boards of several influential academic and practitioners’ journals including the Journal of Intellectual Property Law and Practice by Oxford University, the Trademark Reporter, Managing Intellectual Property and the Intellectual Property Magazine (Trademark World).

As an IP practitioner, Dr Mostert has on occasion provided service to Former President Nelson Mandela, His Majesty Juan Carlos I of Spain, Stella McCartney, Michael Douglas, Catherine Zeta-Jones, Sylvester Stallone, Luciano Pavarotti, Ernie Els, Jackie Chan and the Shaolin Monks.

Dr Mostert has authored or co-authored eight books on various topics of intellectual property law and contributed chapters to a further two titles. He is also a widely published scholar and his work has been cited by the Constitutional Court of South Africa, the Supreme Court of South Africa, the European Court of Justice, the Supreme Court of Canada, the US Federal Court, the Court of Appeal of Singapore, the Court of Appeal of England and Wales, the High Court of Justice and the Court of Justice of the European Communities, among others.

Dr Mostert has frequently been invited to speak with authority on a wide variety of intellectual property matters from across the world, and returns to Stellenbosch University after his last visit during the International Intellectual Property Conference hosted by the Anton Mostert Chair of IP Law in 2011.

Inaugural Lecture – Prof Owen Dean

Professor Owen Dean will deliver his inaugural lecture on Tuesday 21 May 2013 at 17:30 to mark his investiture as professor of intellectual property law at Stellenbosch University. The topic of his address is Deprivation of Trade Marks Through State Interference in Their Usage. 

Summary:

The lecture will address the topic of deprivation of trade marks, particularly those of tobacco products, by legislative intervention that propose to limit the use of such trade marks for reasons of public interest, particularly public health. With reference to the recent Australian cases where the state succeeded in effectively abolishing the use of tobacco-related trade marks, Prof Dean will analyse the relevant provisions of the South African Trade Marks Act and the Constitution to determine the likelihood that similar legislation may succeed in South Africa. Prof Dean’s lecture will scrutinise the constitutionality of the Australian legislation from a South African perspective, distinguish between deprivation and expropriation in terms of the Constitution and in so doing develop a bespoke theory applicable to the expropriation of trade marks under South African law.

The Chair of Intellectual Property Law will present its annual public lecture on 7 March 2013 with Professor Charles Gielen from Groningen University (Netherlands). The topic of Prof Gielen’s address is “Apple v Samsung – the design wars”. He will examine the significance of trademarks and registered designs for the proprietor’s global advertising strategy and the value of distinctive packaging and product design. The discussion will focus on the matter between Apple Inc. and Samsung Electronics in the USA. As a prominent IP practitioner of international renown, Prof Gielen was directly involved in the case and will present his views on the matter and its impact on intellectual property rights. About the speaker:

Professor Charles Gielen PhD (born on 15 March 1947) holds a law degree from the Catholic University of Brabant in Tilburg and a doctorate degree from the University of Utrecht, the Netherlands.

He is a partner of the Dutch law firm NautaDutilh (www.nautadutilh.com) and works in their Amsterdam office. He is professor of IP law at the University of Groningen. He specialises in intellectual property law. He mainly handles patent and trademark litigation. In trademark matters he acts for Diageo Plc., L’Oreal, the LVMH Group, Intel, Coca-Cola, BMW, Burberry and Lego. In patent matters he handled litigation for Pharmacia, Aventis Pharma, Medtronic and Global Biochem Technology.

He has published several books and articles on subjects involving intellectual property law (in particular patent and trademark law) and is a member of editorial boards responsible for publishing law reviews on intellectual property and competition law such as the European Intellectual Property Review, the European Trademark Reports and “Intellectuele Eigendom & Reclamerecht”.

He is also member of the standing advisory committee to the Dutch government on trademark and design law.

He is past-President of the “Vereniging voor Intellectuele Eigendom” (www.aippi.nl), the Dutch group of the International Association for the Protection of Industrial Property (AIPPI; www.aippi.org ) and forms part of the Executive Committee of this Association. He chairs the Program Committee of AIPPI and is past co-chairman of the Working Committee of Q 114 (Biotechnology including plant breeders rights).

He is past member of the Board of Directors and its Executive Committee of the International Trademark Association (INTA; www.inta.org). He is also past President of the International League of Competition Law (LIDC). He is member of the Board of the anticounterfeiting organisation SNB-REACT in Amsterdam.

On November 8, 2006 he received INTA’ s President Award for outstanding service to the International Trademark Association. On October 6, 2007 the Council of Presidents of AIPPI appointed him Member of Honour of AIPPI for outstanding contributions to and an extraordinary engagement for the fulfilment of the aims of the Association. In 2009 he was appointed member of honour of the Vereniging voor Intellectuele Eigendom.

Chambers Global 2006: “one of the most esteemed lawyers” in the IP-field. In the Chambers Global Guide 2008 and the Chambers Europe Guide 2008 he is revered as the icon of trade mark law in the Netherlands. The International Who’s Who of Business lawyers 2008 under Trademarks: “The Netherlands hosts the highest polling lawyer in Europe: Charles Gielen of NautaDutilh received more votes than any lawyer here, is “very well known” for his litigation and academic work.”

The Intellectual Property Law SHORT COURSE

The Anton Mostert Chair of Intellectual Property Law (University of Stellenbosch) and the Professional Development Project (University of Cape Town) is pleased to announce a short course (3 days) in IP law aimed at non-legal or non-IP practitioners, those in business, commerce, engineering, arts or sciences or indeed anyone with an interest in this crucial field of law.

The course is specifically designed to provide students with an introduction to this field of law and its practical application, and has no admission or examination requirements.

Presented by leaders in the field of IP law from both Universities, the course promises to be both exciting and rewarding while equipping students with a sound understanding of how relevant (and indeed crucial) IP is to every endeavour. To this end, the course will include specific reference to aspects of IP and IP law relating to and derived from electronic commerce, communication and digital work.

The course is kindly hosted on the campus of the University of Cape Town, and all full participants will receive a certificate from Stellenbosch University.
