{"id":3010,"date":"2015-07-14T09:38:52","date_gmt":"2015-07-14T07:38:52","guid":{"rendered":"http:\/\/blogs.sun.ac.za\/law\/?p=3010"},"modified":"2015-07-14T09:43:28","modified_gmt":"2015-07-14T07:43:28","slug":"debt-order-ruling-shows-sus-impact-on-society-says-rector","status":"publish","type":"post","link":"https:\/\/blogs.sun.ac.za\/law\/debt-order-ruling-shows-sus-impact-on-society-says-rector\/","title":{"rendered":"Debt order ruling shows SU&#8217;s impact on society, says Rector"},"content":{"rendered":"<p>The High Court ruling on Wednesday (8 July 2015) in favour of an application by the Stellenbosch University (SU) Legal Aid Clinic about emoluments attachment orders (EAOs, also known as garnishee orders) \u201cis an illustration of SU\u2019s endeavour to make a positive impact on society.\u201d<\/p>\n<p>So said SU Rector and Vice-Chancellor Prof Wim de Villiers in reaction to the ruling. He congratulated the Legal Aid Clinic and other participants in the case.<\/p>\n<p>\u201cWe like to use our knowledge to help find solutions to societal challenges. SU took up this case in the public interest.\u201d<\/p>\n<p>Businesswoman Wendy Appelbaum, who was the driving force behind the case, welcomed the ruling. She first approached the Legal Aid Clinic in 2012 when she found out EAOs had been obtained against some of the workers on her wine farm, De Morgenzon.<\/p>\n<p>\u201cI started doing my own research and realised a great injustice was being done. The Legal Aid Clinic had been handling a lot of these cases, and it was fantastic to work with them to make it a broader case with constitutional grounds and far-reaching implications,\u201d she said.<\/p>\n<p>The Legal Aid Clinic was the first applicant in the case, along with 15 of its clients \u2013 farmworkers, cleaners and security guards from Stellenbosch and surrounds who had sought help after micro-lenders had obtained EAOs against them, seizing a large portion of their salaries.<\/p>\n<p>Justice Siraj Desai of the High Court in Cape Town declared the EAOs in question \u201cunlawful, invalid and of no force and effect\u201d. He also found that sections of the Magistrates\u2019 Court Act are \u201cinconsistent with the Constitution\u201d.<\/p>\n<p>\u201cThe ruling is a great victory \u2013 not just for the applicants, but for the poor in general. It sets a precedent that will hopefully clean up the lending industry. And it focuses the state\u2019s attention on its duty to ensure that justice is done for all,\u201d Appelbaum said.<\/p>\n<p>In his judgment, Desai raised two sets of objections. On the one hand there is insufficient \u201cjudicial oversight\u201d over EAOs when they are issued by a clerk of the court without the involvement of a magistrate. The Magistrates\u2019 Court Act makes provision for such a procedure, but only if debtors give their written consent. However, Desai found debtors are routinely influenced to sign forms that they do not understand, or that their signatures are blatantly forged.<\/p>\n<p>He strongly criticized what he called \u201cpredatory lending practices by credit providers\u201d and urged the Ministers of Justice and of Trade and Industry, as well as the National Credit Regulator, the Human Rights Commission and the Law Society to \u201ctake whatever steps they deem necessary to alert debtors as to their rights in terms of this judgment.\u201d<\/p>\n<p>Desai\u2019s other main objection was that orders of this nature are often obtained in courts far removed from the applicants homes and places of work. He found that this \u201ceffectively denied\u201d debtors the \u201cright to approach the courts\u201d and was also based on a misinterpretation of the Magistrates\u2019 Court Act.<\/p>\n<p>The ruling outlines the circumstances that led to the predicament of the debtors in question. They are described as \u201clow income earners\u201d supporting \u201cthemselves and their families on salaries of between R1\u00a0200 and R8\u00a0000 per month. They got loans to keep the pot boiling \u2013 \u201cat interest rates of 60% per annum\u201d.<\/p>\n<p>\u201cThe individual applicants were granted the loans with the repayments at times exceeding 50% of their monthly income. The affordability assessment was either perfunctory or non-existent. These were quite obviously reckless loans and unsurprisingly the applicants defaulted on their repayments.\u201d<\/p>\n<hr \/>\n<p style=\"text-align: justify\"><strong>Hofuitspraak oor skuldbevele wys US se impak, s\u00ea Rektor<\/strong><\/p>\n<p style=\"text-align: justify\">Die Hooggeregshofbeslissing Woensdag (8 Julie 2015) ten gunste van die Regshulpkliniek van die Universiteit Stellenbosch (US) se aansoek oor besoldigingsbeslagleggingsbevele (BBB\u2019s) \u201cis \u0149 uitbeelding van ons strewe om \u0149 positiewe impak op die samelewing te maak\u201d.<\/p>\n<p style=\"text-align: justify\">S\u00f3 het prof Wim de Villiers, Rektor en Visekanselier, in reaksie op die uitspraak ges\u00ea. Hy het Regshulpkliniek en ander betrokkenes gelukgewens.<\/p>\n<p style=\"text-align: justify\">\u201cOns gebruik graag ons kundigheid om oplossings te help vind vir maatskaplike uitdagings. Die US het hierdie saak in die openbare belang opgeneem.\u201d<\/p>\n<p style=\"text-align: justify\">Me Wendy Appelbaum, \u0149 sakevrou en die dryfveer agter die saak, het die uitspraak verwelkom. Sy het die Regshulpkliniek in 2012 genader toe daar BBB\u2019s teen van die werkers op haar wynplaas, De Morgenzon, bekom is.<\/p>\n<p style=\"text-align: justify\">\u201cEk het my eie navorsing begin gedoen en besef hier vind \u0149 groot onreg plaas. Die Regshulpkliniek was reeds besig met \u0149 klomp sake, en dit was fantasties om met hulle saam te werk om dit \u0149 wyer saak met grondwetlike gronde en verreikende implikasies te maak,\u201d het sy ges\u00ea.<\/p>\n<p style=\"text-align: justify\">Die Regshulpkliniek was die eerste applikant in die saak, tesame met 15 van sy kli\u00ebnte \u2013 plaaswerkers, skoonmakers en veiligheidswagte van die omgewing wat om hulp aangeklop het nadat mikroleners hofbevele teen hulle bekom het om beslag te l\u00ea op \u0149 groot deel van hul salarisse.<\/p>\n<p style=\"text-align: justify\">Regter Siraj Desai van die Hooggeregshof in Kaapstad het die betrokke BBB\u2019s Woensdag \u201conwettig\u201d en \u201congeldig\u201d verklaar. Hy het voorts ook bevind dat sekere bepalings van die Wet op Landdroshowe strydig met die Grondwet is.<\/p>\n<p style=\"text-align: justify\">\u201cDie uitspraak is \u0149 groot oorwinning \u2013 nie net vir die applikante nie, maar vir die armes in die geheel. Dit stel \u0149 presedent wat hopelik die leningsbedryf gaan skoonmaak. En dit vestig die staat se aandag op sy plig om geregtigheid vir almal te laat geskied,\u201d het Appelbaum ges\u00ea.<\/p>\n<p style=\"text-align: justify\">In sy uitspraak het Desai twee stelle besware geopper. Enersyds was daar nie voldoende geregtelike oorsig oor die betrokke BBB\u2019s nie omdat die bevele deur klerke van die hof bemiddel is sonder \u0149 besluit deur \u0149 landdros. Die Wet op Landdroshowe het tot nou toe wel voorsiening gemaak vir so \u0149 prosedure mits skuldenaars daartoe instem, maar Desai het bevind die skuldenaars is be\u00efnvloed om vorms te teken wat hulle nie behoorlik verstaan het nie, of dat hul handtekening blatant vervals is.<\/p>\n<p style=\"text-align: justify\">Hy het hom sterk uitgespreek teen wat hy \u201croofdieragtige leningspraktyke deur kredietverskaffers\u201d genoem het, en ges\u00ea die Ministers van Justisie en van Handel en Nywerheid, asook die Nasionale Kredietreguleerder, die Menseregtekommissie en die Regsvereniging moet \u201calle nodige stappe neem om skuldenaars in kennis te stel van hul regte ingevolge hierdie uitspraak\u201d.<\/p>\n<p style=\"text-align: justify\">Desai se ander hoofbeswaar is dat bevele van hierdie aard dikwels verkry word van howe ver van skuldenaars se woon- of werkplekke. Dit belemmer hul se reg om die howe te nader, en berus boonop op \u0149 waninterpretasie van die Wet op Landdroshowe.<\/p>\n<p style=\"text-align: justify\">Die uitspraak skets die omstandighede wat daartoe gelei het dat die applikante in die knyp beland het. Hulle word beskryf as mense met \u0149 \u201clae inkomste\u201d wat hul families op salarisse van \u201ctussen R1\u00a0200 en R8\u00a0000 per maand\u201d onderhou. Hulle het lenings gekry om die pot aan die kook te hou \u2013 teen \u201crentekoerse van 60% per jaar\u201d.<\/p>\n<p style=\"text-align: justify\">\u201cLenings is toegestaan sonder inagneming van die aansoekers se geldelike posisie en verpligtinge. In sekere gevalle het hul terugbetalings meer as 50% van hul maandelikse inkomste beloop. Dit was roekelose lenings, en is dus nie verbasend dat die aansoekers agter geraak het met hul terugbetalings nie,\u201d het Desai ges\u00ea.<\/p>\n<p style=\"text-align: justify\">Hy voer aan \u0149 \u201cskuldenaar sal dalk toegee dat hy agter geraak het, maar dit is hoogs onwaarskynlik dat hy sal instem tot onbekostigbare premies wat van sy salaris verhaal moet word, en dat die saak beslis moet word in \u0149 hof waartoe hy nie toegang het as hy die ongenaakbare voorwaardes van sy beslagleggingsbevel wil betwis nie\u201d.<\/p>\n<p style=\"text-align: justify\">Hy het beslis van die respondente \u2013 spesifiek al die mikroleners behalwe een wat nie die aansoek teengestaan het nie, en hul regsfirma wat gebruik is om skuld in te vorder \u2013 moet die applikante se regskoste dra. Die regsfirma Webber Wentzel het <em>pro bono<\/em> opgetree.<\/p>\n<p style=\"text-align: justify\">Me Odette Geldenhuys van Webber Wentzel het verduidelik slegs die Grondwetlike Hof kan wetgewing ongrondwetlik verklaar, en dus moet Desai se uitspraak dat sekere artikels van die Wet op Landdroshowe ongrondwetlik is, vir bevestiging verwys word.<\/p>\n<p style=\"text-align: justify\">Desai het uitgewys \u201cmiljoene mense landswyd is weens misbruik van die BBB-stelsel in \u0149 soortgelyke situasie vasgevang\u201d.<\/p>\n<p style=\"text-align: justify\">Geldenhuys het benadruk dat nie alle BBB\u2019s nou eensklaps ongeldig is nie. \u201cDie hof het nie \u0149 probleem met BBB\u2019s as sodanig nie \u2013 net as dit misbruik word en onregmatig bekom is. As jy \u0149 BBB teen jou het, vat al jou dokumente na \u0149 prokureur of advieskantoor of regshulpkliniek toe sodat hulle kan kyk of daar ongerymdhede is.\u201d<\/p>\n<p style=\"text-align: justify\">Me Mathilda Rosslee, Ko\u00f6rdineerder van die Regshulpkliniek se Finansi\u00eble Geletterdheidsprojek, s\u00ea sy en haar kollegas hanteer \u201cbaie sulke sake\u201d. Sy alleen het jaarliks gemiddeld 163 skuldverwante sake op haar lessenaar.<\/p>\n<p style=\"text-align: justify\">\u201cOns gaan wel ook proaktief te werk deur opleiding in skole en op plase aan te bied oor geldsake. Ons glo dat kennis mense bemagtig, en dat ons sodoende \u0149 toename van hierdie probleme kan teenwerk,\u201d het sy ges\u00ea.<\/p>\n<p style=\"text-align: justify\">Die US se Regshulpkliniek funksioneer as \u2019n volwaardige prokureurskantoor wat gratis regsdienste bied aan behoeftiges, terwyl daar terselfdertyd opleiding verskaf word aan finalejaarstudente en kandidaatprokureurs. Sy prokureurs en kandidaatprokureurs verskyn in landdroshowe dwarsoor die Boland, en die Regshulpkliniek verleen ook ondersteuning aan advieskantore in Ceres, Klapmuts, Worcester en Franschhoek. Die Regshulpkliniek bied voorts werkswinkels aan oor uitsetting, skuldverligting en gesinsgeweld.<\/p>\n<p style=\"text-align: justify\">\u201cDie Suid-Afrikaanse regsstelsel kan slegs doeltreffend wees as dit toeganklik en geloofwaardig is in die o\u00eb van gewone mens.
